Governor Greg Abbott has instructed the Texas Department of Public Safety (DPS) to strengthen enforcement efforts targeting vape and smoke shops that do not comply with state laws. The directive aims to address concerns over the sale of certain hemp products.
“Texas will protect children from dangerous hemp products,” said Governor Abbott. “Today, I directed the Texas Department of Public Safety to increase surveillance and enforcement of any vape and smoke shop violating Texas law. Texas will prioritize protecting our children.”
Under this directive, the DPS Criminal Investigations Division (CID) will focus on identifying vape and smoke shops considered problematic. CID agents will collaborate with local, state, and federal partners to inspect these businesses for potential legal violations. The CID Special Agents are also expected to conduct undercover operations based on inspection findings in order to detect illegal activity and begin further criminal investigations.
Products seized during these investigations will be tested by the DPS Crime Lab. If violations are found, CID Special Agents will pursue charges against employees or shop owners as warranted under Texas law. Additionally, DPS plans to work closely with both federal and local law enforcement agencies during these investigations.
This action follows an executive order issued by Governor Abbott last month that called on multiple state agencies—including the Texas Department of State Health Services, the Texas Alcoholic Beverage Commission, and DPS—to take steps aimed at safeguarding children from hemp-derived products while maintaining compliance with federal law and upholding adult liberties.
