TDHCA launches tools aimed at easing multifamily housing compliance

The Texas Department of Housing and Community Affairs (TDHCA) has introduced a set of new tools aimed at simplifying the multifamily compliance process for properties it monitors. The resources are intended to help property owners and managers adhere to affirmative marketing and tenant selection criteria rules.

Among the updates is an enhanced Multifamily Affirmative Marketing Tool, which now includes individual TDHCA-monitored properties and allows users to search by city, zip code, or street address. The tool also features updated instructions on how to complete HUD 935.2A forms. It can be accessed at https://www.tdhca.texas.gov/MF-Affirmative-Marketing-Tool.

Additionally, a Simplified Affirmative Marketing Plan Form has been released for use by properties participating in TDHCA programs that do not require the HUD 935.2A form. This streamlined form follows TDHCA’s affirmative marketing rules and reduces paperwork from 12 pages to less than two pages. To assist staff preparing affirmative marketing plans, TDHCA has published an Affirmative Marketing Checklist designed to identify major areas of non-compliance through yes/no questions. This checklist helps ensure plans meet TDHCA requirements even when they do not need formal review. There is also a Written Policies and Procedures/Tenant Selection Criteria Checklist intended for those developing or revising tenant selection criteria or written policies for properties. This tool helps staff spot compliance issues with TDHCA rules using straightforward yes/no questions about common errors in tenant selection criteria. “These updates are designed to help property owners and managers remain compliant with TDHCA’s affirmative marketing and written policies and procedures rules, and significantly lower administrative burden without sacrificing protections for tenants and applicants at TDHCA-monitored properties,” according to the agency.
