The Texas Department of State Health Services (DSHS) has adopted emergency rules that ban the sale of consumable hemp products to individuals under the age of 21. The new regulations apply to all licensed and registered sellers in the state and are effective immediately.
According to DSHS, these emergency rules are a response to Governor Greg Abbott’s executive order aimed at protecting minors from exposure to hemp and products derived from hemp. Under the rules, anyone under 21 is considered a minor, and retailers must verify customers’ ages with valid identification before completing a sale. Sellers who violate these provisions may face penalties, including loss of their license or registration.
Health and Human Services Executive Commissioner Cecile Erwin Young approved the rules. They will remain in effect for up to 120 days, with a possible extension of 60 days.
DSHS has also started work on permanent regulations concerning the age requirement and other aspects outlined in the governor’s executive order. A public hearing will be held for comments once proposed permanent rules are published.
