Texas Real Estate Commission considers changes to broker education and experience requirements

The Broker Responsibility Advisory Committee (BRAC) convened on October 15 to review public feedback and discuss issues related to transaction coordinators and the completion of the Information About Brokerage Services (IABS) form.

In August, the Texas Real Estate Commission proposed amendments to Rule 535.56, which sets the education and experience requirements for obtaining a broker license. These changes were recommended by BRAC.

The proposed modifications would double the experience points needed for a broker’s license from 360 to 720. The amount of credit given for a bachelor’s degree would be limited to 300 hours of real estate-related education, but the total requirement of 900 education hours to become a licensed broker would remain unchanged. Additional changes include allowing up to 300 hours of the required real estate education to be substituted with experience points earned above the minimum threshold, changing how property management experience is calculated from per property to per property per year, and shifting brokerage management/delegated supervisor calculations to a points-per-transaction model.

Currently, applicants receive full credit for 630 hours of real estate-related education if they hold a bachelor’s degree and must have at least four years of active experience within the past five years, totaling 360 experience points.

After considering public comments, BRAC has recommended that the Commission adopt these proposed changes.

During its meeting, BRAC also addressed concerns about transaction coordinators and showing agents providing services for multiple brokerages. The committee plans to continue this discussion at its next session.

There was further discussion regarding agents not fully completing the IABS form and whether this causes confusion among consumers about whom to contact during transactions. The committee recommended that more educational resources on completing the IABS form be provided to license holders.
